A stop-work order is one of the most serious actions a building department can take. It requires all construction activity to cease immediately until the underlying issue is resolved. Violating a stop-work order can result in criminal penalties, substantial fines, and the forced removal of any work completed after the order was issued.
Stop all work. This is not optional. Any work performed after a stop-work order is issued is subject to removal at your expense and may result in criminal charges.
Contact the building department. Find out exactly why the order was issued and what is needed to have it lifted.
Notify your contractor. If a contractor is performing the work, they must be informed immediately. If the stop-work order was caused by the contractor's failure (e.g., not pulling permits), document this carefully.
The process for lifting a stop-work order depends on why it was issued. Typically, you must apply for the required permits (or correct the deviation from approved plans), pay any applicable fees or penalties, and pass inspection before work can resume.
If the stop-work order was caused by a contractor's failure — such as working without permits or deviating from plans — you may be able to recover your losses from the contractor. These losses can include delay damages, the cost of permits and penalties, and any additional costs caused by the work stoppage.
